He Who Hesitates Is Lost

I am attorney Jonna Spilbor with your 60-Second Legal Lowdown. The phrase, “he who hesitates is lost,” takes on a whole new meaning when it comes to personal injury law. Here is what you need to know.

One, the law is very strict when it comes to the time you have to sue after an injury. For example, if you get run over by a state-operated bulldozer, failure to quickly file a notice of claim can result in your case being thrown out. Not exactly music to your ears if you are in a body cast now, is it?

Two, get rear-ended by an absent-minded driver and typically the law gives you a full three years to sue for negligence. But if an absent-minded doctor takes out the wrong body part, the malpractice statute of limitations is six months shorter than that. And,

Three, intentional acts against you have a short shelf life. If someone pushes, shoves, kicks, chokes, pulls a weapon, or otherwise acts like a jerk causing you injury, the law shrinks the time you have to file a complaint typically to one year.
